This Privacy Policy describes the practices of VRAFY LLC (“VRAFY”) regarding the use of information we collect about you. The VRAFY website, www.vrafy.com, is comprised of various web pages, applications, and features operated by VRAFY (collectively, the “Site”). The Site provides a variety of tools and resources that allow you to learn about and explore our prescription generating software services to help your soil meet predetermined goals (our “Services”). The terms “we,” “our” and “us” refer to VRAFY, its subsidiaries and affiliates. The terms “you” or “your” refer to any individuals or entities who provide us information or access this Site.  The term “Dealer” means any dealer that has entered into a Dealer Agreement, Reseller Agreement, or other agreement with VRAFY to facilitate the provision of the Services to customers.

By using the Site or Services, you acknowledge that you have read this Privacy Policy and accept its terms. If you do not agree to the Privacy Policy after your close and careful reading, you should not access the Site, use the Services, or provide us information. We may modify this Privacy Policy at any time by posting a revised version on the Site. Any modification will be effective on the Effective Date that appears at the top of this Privacy Policy, as modified. You acknowledge and agree that it is your responsibility to review this Privacy Policy from time to time in order to learn about any modifications.

Information We Collect

Personal Information. We collect and store in our database personal information from you when you voluntarily provide such information, such as when you complete and submit a form on our Site. “Personal Information” is information that can reasonably identify you or your household, including:

  • Contact information (name, address, email address, telephone number, etc.); and
  • Relationships you have with our affiliates, subsidiaries,  Dealers, other third-party service providers, and laboratories.

We do not store other common types of Personal Information such as your social security number, birthdate, driver’s license number, passport number, or loan or credit card numbers. We also do not collect or store Personal Information regarding your gender, marital status, sexual preference, religious or philosophical beliefs, membership of a political or trade association, ethnic origin or race, data regarding your personal transactions, biometric data, health data, or data relating to your education, profession or employment.

Information from Third Parties. In the course of providing our Services through the Site, information about you may be collected from third-party service providers, such as Dealers. For example, we may receive and store your contact information received from Dealers whom you contact to obtain the Services.

Non-Personal Information.  We also collect and store other non-Personal Information such as:

  • Type of browser and operating system used to access the Site;
  • Device type and user ID;
  • Date and time of your visit to the Site;
  • Actions you performed or attempted on the Site, including clickstream data;
  • Codes that correspond to the status of your actions on the Site; and
  • Geographic location of the computer, mobile device, or other device you use to access the Site.

To the extent any non-Personal Information is defined as “personal information” or “personal data” under the laws of any state or territory of the United States, then, with respect to residents of that state or territory, we will treat such information as if it was personal information or personal data, as applicable, in compliance with applicable state law.

Cookies, Web Beacons, and Server Logs. Our Site uses cookies and other similar technologies which are automatically generated, sent to your browser, and stored on your hard drive to record information about how and when you use our Site. These cookies and other similar technologies identify a web browser on a specific computer or device and reveal certain non-Personal Information such as browser type, language, time zone, and operating system.  Our Site may also use web beacons or pixel tags and other similar technologies, which are not placed on your computer but instead are embedded on certain pages of our Site or in emails.  When you visit a page or read an email with a pixel tag, web beacon, or other similar technology, a generic notice of your interaction is generated.

How We Use Your Information

Provision of Services. We use your Personal Information to enable us to provide the Services and to email or otherwise communicate with you regarding the Services.

Site Analysis. We also use your information for statistical analysis and for editorial or feedback purposes. Information collected by us may be added to our databases and used for future e-mails or postal mailings regarding Site updates, new services, upcoming events, and/or status of orders placed online. We often conduct research using the information provided to us. This research may be compiled and analyzed on an aggregate basis, and we may share this aggregate data with our affiliates, agents, lenders and Dealers. Aggregate information does not identify you personally. We may also disclose aggregated statistics in order to describe our Site to current and prospective Dealers and to other third parties for other lawful purposes.

Disclosure to Our Service Providers. We may also disclose your information to companies that act as third-party service providers to us in connection with providing the Services, including Dealers and our information processing, email, texting and browser push notification service providers.

Business Transactions. If we undergo any type of business transaction, including but not limited to an asset sale, merger, acquisition, bankruptcy, or restructuring, your information may be disclosed to any potential or actual purchasers and may be transferred to the new owners.

Legally Required Disclosures. We may disclose your information where necessary, including, but not limited to:

  • Enforce our Terms and Conditions and Terms of Use of the Services, including investigating potential violations;
  • Protect the rights, safety, and security of Site users, our services or equipment, or any third-party partner or Dealer;
  • Detect, prevent, investigate, or otherwise mitigate fraud, security or technical issues related to our services or our Dealers; or
  • Comply with any applicable law, regulation, subpoena or legal process; respond to any governmental requests; and/or cooperate with law enforcement, if we believe such action is required or permitted by law.

Publicly Posted Information or Content. We may provide opportunities on the Site for you to publicly post reviews, comments, or other content, which may include Personal Information. Please carefully consider what you decide to share in these public forums.

No Sale of Personal Information. We do not sell your Personal Information.

Data Retention. We will store your information, including Personal Information, for as long as is necessary for the uses for which such information was collected, as explained in this Privacy Policy. In some circumstances, we may store your information for longer periods of time, for example, when we are required to do so in accordance with legal, regulatory, tax, or accounting requirements. In specific circumstances, we may store your information for longer periods of time so that we have an accurate record of your dealings with us in the event of any complaints or challenges, or if we reasonably believe there is a prospect of litigation related to your information or your dealings. Subject to the applicable legal requirements, we will delete and/or anonymize your Personal Information when it is no longer needed in our sole discretion.

Your Opt-Out Rights

Communications. You may opt-out of receiving marketing communications from us by writing to us at the address below, by sending an email requesting removal through our contact form, by selecting the unsubscribe link on any email we send to you, or by entering your e-mail address on our unsubscribe page. You may later request that we resume sending marketing communications to you by writing to us at the address below or by requesting reinstatement through our contact form.

Do Not Sell List. We do not sell your Personal Information and you do not need to opt out of this process. However, you may request to be added to our Do Not Sell list by writing to us via postal mail at the address below, by requesting removal through our contact form, or by completing and submitting our “Do Not Sell My Personal Information” form

Request to Delete Personal Information. You may request that we delete your Personal Information by writing to us at the address below or by completing our “Delete My Personal Information” form,, or by emailing us at info@vrafy.com with the subject line “Do Not Sell My Personal Information.” Please note that we may be unable to provide the Services or complete any pending requests if you elect to delete information we or our Dealers need to provide the Services or process such requests. In addition, once we delete your Personal Information, we will not be able to retrieve it. We will delete your Personal Information within 45 days of your request unless we are otherwise required to keep the information to comply with federal, state or local laws and regulations. We will also direct any of our third-party service providers who received your Personal Information to delete your Personal Information from their records.

Cookies, Web Beacons, and Similar Technologies. You can manage cookie preferences and opt out of having cookies and other similar collection technologies used by adjusting the settings on your web browser.  If you do not want cookies stored on your computer, you can change the settings on your browser to notify you when a cookie is about to be saved or block cookies entirely.  Browser types vary as to how to access these settings, which settings are available, and how to turn on these settings. We encourage you to further investigate your browser’s privacy settings if you wish to opt out or adjust these settings in any way.  If you choose to decline or block cookies, you may not be able to fully utilize all of the interactive features of the Site. You cannot decline web beacons; however, setting your browser to decline cookies or to prompt you for a response, or installing an ad-blocker, may keep web beacons from tracking your activity.

Disclosure Regarding Tracking and Advertising Features. We use Google Analytics and other web-based services to analyze traffic on the Site. Google Analytics collects data including details about your web browser and the computer you use to access our Site (e.g., hostname, browser type, referrer, language, and screen resolution). Google Analytics also sets and reads first-party cookies to obtain user session and ad campaign information from your page request. Google provides users an opportunity to opt out of Google Analytics Features through Google Ads Settings and their web browser opt-out plugin (https://tools.google.com/dlpage/gaoptout/). Do Not Track Signals. Our Site does not currently respond to automated signals regarding online tracking, such as “do not track” instructions from your web browser. Please note that blocking cookies or other tracking technologies may affect your browsing experience on the internet and may limit your use of certain parts of our Services.

Other Third-Party Content. We may display other third-party content or links to third-party websites or applications on the Site, including links to Dealers. Please be advised that when you leave our Site or interact with a third-party feature, you should read the applicable privacy policies and terms of service of those parties so that you understand their own information collection and sharing practices.

Information Security

We maintain what we believe to be industry-standard technical, physical and administrative security procedures and practices to protect your Personal Information against unauthorized access, disclosure, destruction, use, alteration, or disclosure. We use encryption in the transmission of your Personal Information between your system and ours and the Site. We also use firewalls and other intrusion detection and prevention controls to help prevent unauthorized persons from gaining access to your Personal Information. We also require our employees to comply with our internal information security policies.

Because no data transmission is completely secure, and no system of physical or electronic security is impenetrable, we cannot guarantee the security of your Personal Information; your communications or other activities on the Site; or the security of our servers, networks or databases. By using the Site, you agree to assume all risk in connection with the information sent to us or collected by us when you access, visit and/or use the Site. We are not responsible for any loss of such information or the consequences thereof.

Moreover, if you elect to store information, such as your Personal Information, where others may access it, we are not responsible for any loss of such information or the consequences thereof. If you lose a computer, mobile or other device, or a device is stolen, that contains your Personal Information or other information, it is up to you to take all the steps necessary to protect yourself.

In the unlikely event that we believe that the security of your Personal Information in our possession or control may have been compromised, we may seek to notify you. If notification is appropriate, we may notify you via your computer, mobile or other device.

Information of Children

Our Site is not directed to anyone under the age of 18, and by using this Site, you are confirming that you are 18 years of age or older.  If a parent or guardian is aware or becomes aware that his or her child has provided us with Personal Information without consent, please contact us using our contact form so we can remove the unauthorized information from our records.

This Site is not intended to solicit information of any kind from children under the age of 13.  We do not knowingly collect or store information of children under 13, even in aggregate form.  It is possible that through fraud or deceit we may receive information pertaining to children under the age of 13.  Parents or guardians may report unauthorized use of our Site by a child under age 13 by contacting us using our contact form.  If we are notified of unauthorized use by a child under 13, upon verifying the information, we will immediately delete the unauthorized information from our servers and records.

California Residents’ Privacy Rights

This section applies to the personal data of California residents.

Shine the Light. California Civil Code section 1798.83 requires certain businesses to respond to requests from California customers asking about their businesses’ practices related to disclosing personally identifiable information to third parties for the third parties’ direct marketing purposes.  California residents who provide personally identifiable information in obtaining products or services for personal, family, or household use are entitled to request and obtain from us, free of charge and once a calendar year, information about the customer information we shared, if any, with other businesses for their own direct marketing purposes. In compliance with this law, California residents with whom we have an established business relationship are entitled to request and receive, free of charge, once per calendar year, a copy of VRAFY’s Information Sharing Disclosure Notice about the customer information we shared, if any, with other businesses for their own direct marketing purposes in the previous calendar year (e.g., requests made in 2023 will receive information regarding 2022 sharing activities).  To obtain this information, please contact us using our contact form with “Request for California Privacy Information” in the subject line and in the body of your message. We will provide the requested information to you at your email address.  Please be aware that not all information sharing is covered by the “Shine the Light” law requirements and only information on covered sharing will be included in our response to your request.

California Consumer Privacy Act.
